Thank you for accessing the RogueFitness.com/eu Website (“Site”) operated by Coulter Ventures, LLC d/b/a Rogue Fitness, which also owns Reflex Fitness, LLC (collectively, “Rogue”). Rogue is a sports equipment manufacturer headquartered in Columbus OH and acts as the controller when collecting your personal data. We respect your privacy and want to protect your personal data.
This Privacy Policy explains how we collect, use, and disclose your personal data. This Privacy Policy also explains the steps we have taken to secure your personal data. Finally, this Privacy Policy explains your options regarding the collection, use and disclosure of your personal data. By visiting the Site directly or through another site, you accept the practices described in this Policy.
You are viewing the European Union version of our Privacy Notice (“EU Notice”), which applies to our processing of personal data of EU residents. This EU Notice is for individuals residing in EU Member States and is designed to help you better understand how we collect, use, and disclose your personal data and how to exercise available rights under the applicable privacy laws in the EU, including the EU General Data Protection Regulation (“GDPR”).
INFORMATION COLLECTION, USE, AND DISCLOSURE
1. Collection
We collect information from you in several different ways on this Site. Information we may collect includes:
- Information Collected as Part of Registration and Ordering. Before using certain parts of any Site or ordering products, you must complete an online registration form. During registration, you will be prompted to provide certain personal data, including but not limited to your name, shipping and billing address(es), phone number, and email address. In addition, we may also ask for your country of residence and/or your organization’s country of operation, so we can comply with applicable laws and regulations. These kinds of personal data are used for billing purposes, to fulfill your orders, to communicate with you about your order and the Sites, and for internal marketing purposes. If we encounter a problem when processing your order, your personal data may be used to contact you.
- Email Addresses. Several locations of the Site permit you to enter your email address for purposes including but not limited to: to create a gift registry, to request us to notify you of new products, or to sign up for email newsletters and special offers.
- Information Collected Through Cookies and Similar Technologies. Like many sites, the Site employs cookies, pixels, tags, web beacons, and other similar technologies to speed your navigation of the Site, recognize you and your access privileges, and track your Site usage. We also use third-party advertising companies to help tailor site content to users or to serve ads on our behalf. These companies may employ cookies, tags, pixels, and similar technologies to measure advertising effectiveness (such as which web pages are visited or what products are purchased and in what amount). For more information about our use of cookies, please see our Cookie Policy.
- Technical Information. As is true of most web sites, the Site server automatically recognizes the Internet URL from which you access the Site. We may also log your Internet protocol (“IP”) address, Internet service provider, and date/time stamp for system administration, order verification, internal marketing, and system troubleshooting purposes. (An IP address may indicate the location of your computer on the Internet.)
- Product Reviews. You may choose to submit a product review. If you post a review, we will ask for your email address (your email address will be kept private). Any personally identifiable information that you submit as part of the review can be read or used by other visitors to the Site. We are not responsible for any personally identifiable information that you choose to submit as part of your review. We believe you can post a helpful review without disclosing any personal data.
2. Use
We use your personal data to:
- Improve Site Functionality. We use your information to improve site functionality, such as making the Site easier for you to use and helping you quickly find information, products, and services.
- Provide Products and Services. We use your personal data to process your order, provide you with customer service, and provide our products and services.
- Improve Our Services. We may use your personal data to improve the Sites’ content and layout, to improve outreach, and to determine general marketplace information about visitors to the Site.
- Communicate with You. We will use your personal data to communicate with you about the Site and your orders and deliveries. This can include a confirmation email when you register with us, and service-related announcements. Also, you may submit your email address for reasons such as to create a gift registry, to request us to notify you of new products, or to sign up for email newsletters and special offers. We always permit you to unsubscribe or opt out of future emails (see the opt-out section below for more details). Because we have to communicate with you about orders that you choose to place, you cannot opt out of receiving emails related to your orders.
- Advertise and Market to You. We may use your personal data to tailor or deliver advertisements to you, and for our marketing efforts (including marketing our services and products to you).
- Comply with Legal, Regulatory, and Related Obligations. We may use your personal data to comply with legal, regulatory, or related obligations, including to protect our legal rights.
3. Disclosure
We want to provide you with excellent service and to offer you a great selection. We do not sell, rent, trade, license or otherwise disclose your personal data or financial information to anyone other than:
- Service Providers: As do most catalog and Internet retailers, we sometimes use others to perform specific functions on our behalf. When we disclose information to these service providers, we disclose information to help them to perform their service. For example, to deliver products to you, we must share some information. We partner with third parties to ship products, to ensure delivery, and so that we can obtain feedback, improve the quality of our service, and measure and improve the quality of the service of the third party. In the example of shippers, we provide them some personally identifiable information such as your name, shipping address, email, and phone number. Similarly, to help you buy products and provide customer service to you, we must provide your credit card number to financial-services corporations such as credit-card processors and issuers. When we submit your credit card number for authorization, we employ appropriate and reasonable data encryption to protect your information. (More on this below in Data Security.)
- Business Partners: We may share information (such as the number of daily visitors to a particular web page, or the size of an order placed on a certain date) with third parties such as advertising partners. For example, we use the Meta Pixel and Google Analytics on our website—for more information, see our Cookie Policy or Google’s explanation at “How Google uses information from sites or apps that use our services.” We also include content from YouTube, a third-party service that maintains independent Terms of Service.
- Third-Party Integrations: You can choose to share your information with third-party apps, plugins, or websites that you choose to integrate. Information you provide to these third parties is subject to their terms and policies.
- Corporate Affiliates and Business Acquisition or Sale: We share your personal data with our corporate affiliates. It’s possible that we might acquire, merge with, or be acquired by another company or that we might dispose of some or all of our assets. If that happens, your personal data may be disclosed to another company, subject to the Privacy Policy in effect.
- Legal, Regulatory, and Related Third Parties: We may disclose such information in response to requests from law enforcement officials conducting investigations; subpoenas; a court order; or if we are otherwise required to disclose such information by law. We also will release personal data where disclosure is necessary to protect our legal rights, enforce our Terms of Use or other agreements, or to protect ourselves or others. For example, we may share information to reduce the risk of fraud or if someone uses or attempts to use the Site for illegal reasons or to commit fraud.
OFFLINE COLLECTION, USE & DISCLOSURE OF INFORMATION
The majority of information that we collect is obtained through the Site. We also may collect information offline in certain circumstances. One example involves someone calling us to place an order or to ask questions. When someone calls, we will ask only for the personal data we need in order to place the order or to answer the question. When we need to store information (such as order information), we will enter it into our database through SSL encryption. We treat offline collection, uses, and disclosures consistently with our relevant online practices.
LEGAL BASIS
To use your personal data, we must have a valid reason known as the lawful basis or legal grounds for processing. We may process your personal data based on these reasons:
- Your Consent: Sometimes, we will use your personal data because you actively indicated it is okay that we do so. This includes, for example, when your personal data is used for marketing purposes.
- Keeping Our Agreement Obligations: This includes using your personal data to fulfill our agreement with you.
- Legitimate Interests: We sometimes use your personal data because we believe it is in our best interest or in the interest of someone else. Legitimate interests work when we use your personal data in ways that make sense and do not intrude on your privacy much, or when we have a very good reason for it. Here is what it normally means for us:
- Product improvement
- Customer engagement
- Promotions
- Security and fraud prevention
- Legal compliance
- Following the Law: This includes processing your personal data to follow the law.
- Other Reasons: This includes using your personal data for any other reason that the law allows.
If we use legitimate interests as the reason for using your personal data, you can ask us for more details about why we think it is a good idea. Just get in touch using the contact details below.
When we use your personal data because you gave us permission (consent), you can change your mind at any time. However, this will not undo the things we did with your information before you changed your mind. It also will not change the things we are allowed to do with your data based on other reasons.
CONTESTS AND OTHER PROMOTIONS.
From time to time, we may offer contests, sweepstakes or other promotions. Participation in these promotions may require registration. If you participate in these promotions, we collect contact information such as your name, address, and email address and we may share this information with co-sponsors or other third parties involved in the presentation of the promotion that we identify in the rules or entry materials. We don’t control these third parties’ privacy practices, and our Privacy Policy does not apply to their collection and use of your information. We may also share some of your entry information with third parties or the public in connection with the administration of the promotion, such as winner selection and prize fulfillment, and as permitted by the promotion's official rules, such as on a winners' list. Our use of your information in these circumstances will be set out in more detail in our terms and conditions for any such promotions.
HOW LONG WE KEEP YOUR INFORMATION
We keep your personal data as long as we need it to provide our products, comply with legal obligations, or protect our or other’s interests. We decide how long we need information on a case-by-case basis. Here’s what we consider when we decide:
- If we need it to provide our products or services.
- How long we need to retain the information to comply with certain legal obligations.
- If we need it for other legitimate purposes, such as to prevent harm; investigate possible violations of our terms or policies; promote safety, security and integrity; or protect ourselves, including our rights, property or products.
YOUR RIGHTS OVER YOUR INFORMATION
You have rights that you may exercise to protect your personal data. Subject to limited exceptions, you have the following rights concerning your personal data that we hold and process that you can exercise at any time:
- Right of Access: You have the right to request a copy of the information that we hold about you.
- Right of Rectification: You have a right to correct data that we hold about you that is inaccurate or incomplete.
- Right to Be Forgotten: You can ask for the data we hold about you to be erased from our records.
- Right to Restriction of Processing: Where certain conditions apply (such as where you believe the data is inaccurate or the processing activity is unlawful), you have a right to restrict the processing.
- Right of Portability: You have the right to have the data we hold about you transferred to another organization.
- Right to Object: You have the right to object to certain types of processing such as direct marketing.
- Right to Complain: If you wish to raise a complaint on how we handle your personal data, you can contact our Privacy Officer at privacy@rogueeurope.eu. If you are not satisfied with our response you can complain to the data protection authority in your country of residence, place of work, or where you believe the issue has arisen.

Please note that to protect your information and the integrity of our products and services, we may need to verify your identity before processing your request. In some cases, we may need to collect additional information to verify your identity.
If you would prefer to opt out of online RogueFitness.com advertising that may be targeted or tailored to your interests, you can also use the Network Advertising Initiative (NAI) Opt-Out Tool. To opt out of an NAI member’s advertising program, simply follow the steps below:
- Go to the NAI (Network Advertising Initiative) consumer opt-out page by clicking here.
- Check the box that corresponds to the company from which you wish to opt out. Alternatively, you can check the box labeled “Select All” and each member’s opt-out box will be checked for you.
- Next click the “Submit” button. The Tool will automatically replace the specified advertising cookie(s) and verify your opt-out status.
Opting out of a network does not mean you will no longer receive online advertising. It only means that the network from which you opted out will no longer deliver ads tailored to your Web preferences and usage patterns. We do not currently respond to Do Not Track signals.
You may also control your online behavioral advertising preferences and opt out from having your data processed by certain marketing companies by visiting http://www.youronlinechoices.com/ and http://optout.aboutads.info/. Please note, however, that managing these preferences will not turn off internet advertisements in general. You will still receive the same number of advertisements, but those advertisements will be less reflective of your interests, as indicated by your web browsing habits. In addition, please note that the opt-out preferences that you set using these tools may be nullified if you delete your cookies after setting them.
INTERNATIONAL TRANSFER OF PERSONAL DATA
Your personal data may be stored and processed outside of the place where it was collected, including in the United States. In these cases, we will either obtain your explicit consent to transfer your personal data to third parties outside your country, or we will require those third parties to maintain at least the same level of privacy and security that we maintain for such personal data ourselves. We either send it to a country, territory or sector within a country that is recognized as providing the same level of personal data protection as the country of origin, or use safeguards like Binding Corporate Rules or the Standard Contractual Clauses (also known as the “SCCs”) approved by the European Commission under Article 46.2 of the GDPR, with necessary adjustments for transfers from the UK or Switzerland, or use specific transfer instruments like the UK International Data Transfer Agreement. We remain liable for the protection of your personal data that we transfer to our service providers, except to the extent that we are not responsible for the event giving rise to any unauthorized or improper processing.
DATA SECURITY
The Site incorporates physical, electronic, and administrative procedures to safeguard the confidentiality of your personal data, including Secure Sockets Layer (“SSL”) for all financial transactions through the Site. We use SSL encryption to protect your personal data online, and we also take several steps to protect your personal data in our facilities. Access to your personal data is restricted. Only employees who need access to your personal data to perform a specific job are granted access to your personal data. Finally, we rely on third-party service providers for the physical security of some of our computer hardware. We believe that their security procedures are reasonable and appropriate. For example, when you visit the Site, you access servers that are kept in a secure physical environment, behind a locked cage and an electronic firewall.
While we use industry-standard precautions to safeguard your personal data, we cannot guarantee complete security. 100% complete security does not presently exist anywhere online or offline.
CHILDREN
We respect children’s privacy. We do not knowingly or intentionally collect personal data from children under age 13. If you are under the age of 13, please do not submit any personal data to us, and rely on a parent or guardian to assist you.
UPDATES TO THIS POLICY
If we change or update this Privacy Policy, we will provide notice to you as required, including by posting changes and updates on the Site so that you will always be aware of what information we collect, use and disclose. We encourage you to review this Privacy Policy from time to time so you will know if the Privacy Policy has been changed or updated. If you have any questions about the Privacy Policy, please contact us at Contact Us.
