On December 31, Rogue Fitness sued Titan Fitness in the United States District Court for the Southern District of Ohio because Titan Fitness is violating Rogue’s trademark rights. A copy of Rogue’s complaint is available here.
Since 2007, Rogue has dedicated its efforts and resources to designing and manufacturing the highest quality strength and fitness equipment. Located in Columbus, Ohio, Rogue employs hundreds of people in the area and is committed to an America-made approach to maximize product quality, durability, and value for Rogue’s customers. Because of Rogue’s substantial investments in innovation and the local community, Rogue enjoys goodwill with consumers who associate Rogue trademarks with Rogue and its high-quality products and customer service.
In contrast, as explained in Rogue’s complaint, long-after Rogue built its reputation, Titan Fitness relentlessly mimicked, imitated, and copied Rogue’s products and marketing for those products. While Rogue designs and makes the highest quality equipment, primarily from its local facilities in Columbus, Titan imports low-quality imitations from abroad and then markets them using close copies of Rogue’s trademarks.
